1. Service Description
SiteMind ("we," "us") provides website design, development, and managed hosting services for small businesses. Websites are built using publicly available business information and may have been created speculatively before purchase. No payment is owed unless you choose to purchase a plan.

All prices are in USD. Setup fees are charged at the time of purchase. Monthly fees begin 30 days after your site launches, recurring on the same calendar date.
3. 12-Month Commitment & Early Termination
The Website + Hosting plan is a 12-month service agreement. This commitment allows us to offer the low $199 setup fee by distributing infrastructure costs over the plan term.
You may cancel at any time. Cancellations made before the 12-month term is complete are subject to an early termination fee of $350.00. This fee covers the remaining committed infrastructure costs.
No early termination fee applies to: (a) the Website Only plan, (b) the AI Receptionist add-on, or (c) any cancellation made after your 12-month term has been fulfilled.
After 12 months, your plan converts automatically to month-to-month. You may cancel month-to-month service at any time with 30 days' written notice to [email protected].
4. Payment, Late Fees & Service Suspension
Monthly invoices are due on the billing date. Payments are processed automatically via Stripe using the payment method on file.

5. Ownership & Content
Upon full payment of the setup fee, the website content and design are yours. SiteMind retains the right to display completed websites in its portfolio and marketing materials unless you request otherwise in writing.
Website files may be exported and delivered to you as a ZIP archive upon written request. You are responsible for any costs associated with migrating to a third-party host.
6. AI Receptionist Add-On
The AI receptionist service ($149 setup + $79/month) is powered by automated voice and scheduling software, including integration with Cal.com for appointment booking. Setup includes configuration of your business hours, services, and scheduling rules.
The AI receptionist does not replace human judgment. SiteMind is not liable for missed calls, scheduling errors, misdirected inquiries, or any indirect losses arising from use of the automated system. Performance depends on accurate configuration information provided by the client.
7. Infrastructure & Uptime
SiteMind operates websites on privately owned server infrastructure with redundant systems, encrypted connections, and 24/7 monitoring. We maintain high availability but do not guarantee 100% uptime. We are not liable for disruptions caused by: force majeure, third-party internet infrastructure failures, power outages, or circumstances outside our reasonable control.
Planned maintenance will be communicated in advance where possible. Emergency maintenance may occur without notice.
8. Domain Names
For Website + Hosting clients, SiteMind registers and manages your domain name as part of the plan. Domain registration is included in your monthly hosting fee. Upon cancellation, domain transfer to your own registrar account is available at no additional charge with 14 days' notice.
9. Acceptable Use
You agree not to use SiteMind services for any unlawful purpose or to publish content that is defamatory, obscene, or in violation of applicable law. SiteMind reserves the right to suspend service for material violations of this policy without refund.
10. Limitation of Liability
SiteMind's total liability under this agreement is limited to the total amount paid by the client in the 30 days preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or business interruption, even if advised of the possibility of such damages.
11. Governing Law & Disputes
This agreement is governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of Thurston County, Washington. You consent to personal jurisdiction in Thurston County for any claims arising under this agreement.
12. Changes to Terms
SiteMind may update these terms from time to time. Material changes will be communicated via email to the address on file at least 30 days before taking effect. Continued use of services after that date constitutes acceptance of the updated terms.
